LEGAL FEES

Legal fees in personal injury and medical malpractice cases are generally charged on a contingent fee basis. That means that the legal fee will be a percentage of the amount recovered at the end of the case, after deducting for reimbursement of case expenses, such as court filing fees, medical reports, deposition transcripts, etc., which may have been advanced by our office.

In most cases, the fee is one-third of the amount recovered, after expenses. In New York medical malpractice cases, the fee starts at 30% and gradually slides down to 10%, as the amount of the settlement increases. In some cases, notably those settled on behalf of minors, the legal fee must be approved by the court.
